1. Who We Are

Tracenyx Pty Ltd ("Tracenyx", "we", "us") is an Australian company building Nyx — an AI-powered Kubernetes network security and observability platform.

This policy explains what personal and technical data we collect, how we use it, and your rights. It applies to:

  • Users of Nyx (Scout, Sentinel, and Aegis tiers)
  • Visitors to tracenyx.ai and blog.tracenyx.ai
  • Anyone who contacts us via email or our contact form

2. What We Collect

We collect two categories of data — product data from your cluster and account data from you directly.

3. What We Never Collect

Nyx is a network metadata platform — not a packet capture tool. We collect information about connections, not what was inside them.

  • Network packet payloads or content
  • Application data of any kind
  • Secrets, credentials, API keys, or tokens
  • Database contents or query data
  • Customer data processed by your applications
  • Personally identifiable information of your end users

If a payment service processes card numbers, Nyx sees "pod payments-api talked to pod database on port 5432 — allowed" — not the card numbers themselves.

4. How We Use Your Data

  • Provide and operate the Nyx platform and dashboard
  • Power AI anomaly detection and policy recommendations
  • Generate compliance reports (Aegis tier)
  • Send service notifications, alerts, and usage summaries
  • Respond to support requests and contact form enquiries
  • Improve Nyx detection accuracy using anonymised, aggregated patterns (opt-out available)
  • Meet our legal and regulatory obligations under Australian law

We do not use your data for advertising. We do not sell your data to third parties. We do not allow third parties to target advertising based on your data.

5. AI Processing

Nyx uses AI to analyse traffic patterns and generate policy recommendations. Here is exactly what happens:

In standard mode, anonymised pattern summaries are processed by our AI provider (Anthropic). We never send pod names, namespace names, IP addresses, or raw flow log records to any third-party AI service. Only statistical patterns — "namespace X has 40% more east-west traffic than baseline" — are shared, not records.

You can opt out of contributing anonymised patterns to cross-customer AI improvement at any time in your account settings. Opting out does not affect AI features for your own account.

6. Data Storage and Retention

All data is stored in Microsoft Azure. Your preferred region determines where your data is stored:

  • Scout / Sentinel (default): Azure Australia East (Sydney)
  • Aegis: Your preferred region (AU East, US East, West Europe — more regions coming)

Flow log retention by tier:

  • Scout: 7 days
  • Sentinel: 90 days
  • Aegis: 180 days (365-day extended retention available as add-on)

Account data is retained for the duration of your account and for up to 7 years after account closure as required by Australian tax and corporate law.

Contact form data is retained for up to 2 years.

7. Who We Share Data With

We share data with the following third parties only where necessary to operate the platform:

We do not share data with any other third parties. We will disclose data to law enforcement or regulators only when required by Australian law and will notify you where legally permitted to do so.

8. Your Rights

Under the Australian Privacy Act 1988 and applicable laws you have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate or outdated personal data
  • Request deletion of your personal data (subject to legal retention requirements)
  • Opt out of anonymised data contributing to AI model improvement
  • Request your data in a portable format
  • Lodge a complaint with the Office of the Australian Information Commissioner (OAIC)

We will respond to all privacy requests within 30 days.

9. Cookies and Website

tracenyx.ai uses minimal cookies — only those necessary to operate the site. We do not use advertising cookies, tracking pixels, or third-party analytics.

  • Session cookies — keep you logged in to your account
  • Cloudflare security cookies — bot protection and performance

blog.tracenyx.ai (Hashnode) may set additional cookies per Hashnode's own privacy policy.

10. Children

Nyx is an enterprise software platform not intended for use by anyone under 18 years of age. We do not knowingly collect personal data from children.

11. Changes to This Policy

We may update this policy from time to time. We will notify you of material changes via email at least 30 days before they take effect. The "last updated" date at the top of this page always reflects the current version.

Continued use of Nyx after a policy update constitutes acceptance of the revised terms.
